The General Council of Notaries approves the electronic authorisation of financing policies.

Due to the state of alarm, and at the request of the Ministry of Justice, the General Council of Notaries has approved the electronic authorization of policies for the financing of companies and individuals.

Since 14 March, 2020, when the Spanish government declared the state of alarm, the Notaries’ offices, despite being open, only attend to urgent appointments that cannot be postponed.

In view of this situation, the Ministry of Justice has asked the General Council of Notaries to find a solution for processing policies for financing companies and individuals. This entity has unanimously approved the electronic authorization of these policies on the Notaries’ electronic platform and via videoconference.

This solution will allow individuals and companies to interact with the Notaries’ offices without having to travel physically, thus complying with the movement limitations decreed with the state of alarm. Those interested will be able to use any computer, mobile phone or tablet to contact the Notaries of their choice using this electronic platform, who will be able to advise them and authorize these policies.

It will also be possible to obtain simple copies of the public deeds of mortgages and sales for free in order to access the mortgage moratorium. Notaries would send such simple copies directly to the credit entities without cost.

The action through this platform would be done in compliance with all technological guarantees, given that the General Council of Notaries is accredited at the European Union level to use the qualified electronic signature in the cloud, in compliance with the EID@s Regulation.

Finally, enabling videoconferences will allow Notaries to authorize other types of documents such as testaments, special powers of attorney, revocations of powers of attorney and corporate documentation, which will also reduce physical travel to the Notaries’ offices.
